I hear at the most he's facing life in prison. Poor Pvt. Eddie Slovik, the only American soldier executed for desertion since the Civil War. Eisenhower decided to make an example of him, and had him shot for a lot less than what this POS did. Unlike Bergdahl, he didn't desert while on the front lines, he didn't go looking for the enemy...... And, 6 other soldiers weren't killed looking for him. en.wikipedia.org/wiki/Eddie_Slovik

TC, I think the only reason Death isn't on the table is 3 little words ... "Time of War" ... a formal declaration of war hasn't been made.
Eddie got a raw deal, no doubt.

Bergdahl was planning to report what he believed to be problems with “order and discipline” in his unit, a senior defense official tells CNN
U.S. troops who served alongside Sgt. Bowe Bergdahl on the day he disappeared told CNN that the emerging “whistleblower” defense being prepared for him makes no sense.
Bergdahl’s lawyer is making the case that Bergdahl left his post on foot to report his unit for troubling behavior, but his fellow troops say the platoon was already scheduled to drive back to their Forward Operating Base, or FOB, just hours after his disappearance.
“We were literally going back to the FOB Sharana the next day,” then-Sgt. Evan Buetow, Bergdahl’s team leader, told CNN. “If for whatever reason Bergdahl had complaints, he could have brought them to the attention of senior officers before our five-day mission, or easily could have waited a few more hours till we returned to the FOB.”
Then-Specialist Josh Cornelison, the platoon medic, said the base was “a lengthy drive away from” Observation Post Mest, where Bergdahl was last seen by his fellow troops.
“And he wanted to walk back? Knowing full well how many times we’d been blown up on the way there and back? Everyone knew bad dudes were around and watching us move to and from OP Mest,” Cornelison said.
A “lengthy drive,” Taliban everywhere AND the platoon was shipping out the next day? Good luck with that.

In the immortal words of COL Sherman Potter, CO 4077 MASH ... "Horse Hockey!!!"
I gotta ask, is Bergdahl's defense councel military or civilian? I might be able to understand a civilian lawyer with no knowledge dangling this as a possible defense, but a serving officer would have to be dumb as a sack of door knobs to try it.

You're right guys, so have I. I withdraw that part of the statement.
I remember a Navy LT (O-3) caught playing cards in CIC with some of the other watchstanders while we were patrolling off Libya just prior to the strikes Reagan ordered.
Skipper didn't even wait to hit port to throw his ass off the ship, he was extracted by helo and flown to Sigonella. Don't know where he went from there, wasn't particularly interested in following his travels.
