"James Eagan Holmes was found guilty of first-degree murder Thursday in the deaths of 12 people at a Colorado theater three years ago and could face the death penalty. The nine-woman, three-man jury decided Holmes was not insane in the shootings at a screening of a Batman movie, "The Dark Knight Rises," in Aurora, near Denver, on July 20, 2012. He was charged with 24 counts of first-degree murder, 140 counts of attempted murder and an explosives count." www.nbcnews.com/news/us-news/aurora-theater-trial-jury-reaches-verdict-n393391

Guilty on all counts, sentencing phase begins on Monday 7/20. Any bets against Death? Warrior, your community has gone through a lot already. Can you folks bear it a little longer? I can wait, as long as this man pays the ultimate penalty. He knew, you see. I have no doubt of it. The prosecution's case, and my own case against James Holmes, was based upon the fact that he planned this, meticulously, all along.
He purchased the weapons with a credit card that his parents did not have any accesss to the bills. He carefully booby-trapped his apartment. The traps were so clever, the police were not willing to enter it until it had been very carefully cleared. Explosive ordinance professionals were wary of the place. And he documented what he was going to do, and how he was going to do it, and sent the notes to his psychiatrist. And I can't prove it, but I believe he planned to use an insanity defense BEFORE HE COMMITTED THE CRIME. He was brilliant, and insane, but HE KNEW EXACTLY WHAT HE WAS DOING, and NOBODY can tell me different. Yeah, I'll wait. One last thing: My son and I are big fans of comic book movies. I was planning to surprise him and offer to take him to see Batman Begins, and by a dinner at the food court in the mall across the street. but I know he loves his girl very dearly, and decided to take a raincheck so I wouldn't make him decide between me and his girl.
And then, I woke up the next morning and turned on the TV to watch the helicopter cxricling the theater, less than five minutes from my house. We could have been IN THERE, you guys.
Oh yeah.
I can wait.
We can ALL wait.

I only learned last evening that the prosecution, during the sentencing phase, must prove sanity in order for him to get Death. Usually it is the defense that has the burden of proving insanity.
Still, if anyone whether sane or not deserves to die for his crime, Holmes is one. Judging from the fact that the jury only took 13 hours to convict on all counts I'd bet his goose is cooked. 13 hours is only about enough time to poll the jury once on the whole list of charges, maybe with time for an occasional restroom break and a sandwich thrown in.

And I didn't know the burden of proof for sanity rests with the prosecustion. But then, they are dealing with the same jury that found him guilty.
It's being predicted that this will be some extremely heart-wrenching testimony from the victims. THEY want his ASS.

Warrior can you enlighten us as to how he can be convicted on 24 murder counts when he killed 12?
Must be a nuance in CO law the I don't understand.

For each person killed in the shooting, Holmes was charged with one count of murder with deliberation and one count of murder with extreme indifference, all in the First Degree. Each death carried two separate murder charges, one for showing premeditation and one for showing extreme indifference to life. Both of the charges carry the death penalty as a possible sentence.
That's about all I can tell you now; I'll look into that one myself.

It's unfortunate that even if he gets the Death Penalty he's more likely to die of old age than keep an appointment with an Executioner.

It's unfortunate that even if he gets the Death Penalty he's more likely to die of old age than keep an appointment with an Executioner. You're right, of course. I'll tell you a story about Lebanon: The country used to be the capital of the hashish smuggling world. However, Lebanon passed a law that drug smuggling was punishable by death, sentence to be carried out within 24 hours. They passed this when about twenty of the primary smugglers were about to come to trial. They were tried and convicted, and, less than 24 hours later, it's "READY! AIM! FIRE!" Hashish smuggling in Lebanon decreased by about 75% that following year.
